Fairmont WV Business License: 0.35% Retail B&O, Home Rule Ordinance and Credits

Fairmont WV Business License: 0.35% Retail B&O, Home Rule Ordinance and Credits

If you are searching for a fairmont wv business license, the first thing to know is that West Virginia does not issue a general statewide business license. The paperwork you need comes from three separate places: the State Tax Division, the Secretary of State, and the City of Fairmont. The city step is the one most new owners miss. Fairmont levies its own gross-receipts business and occupation (B&O) tax, so a retail business pays 0.35 per $100 of gross receipts, or 0.35%, and a contractor pays 2.00 per $100.

This guide covers what to file, what to pay, where to apply, and the Home Rule credits that may reduce what you owe. City figures can change, so confirm each number with the city before you build it into a budget.

Informational only: This article explains how business licensing and filings work in Fairmont and West Virginia. It is not legal or tax advice. Rates, fees and deadlines can change. For complex situations, including entity choice, activity in more than one city, or how the B&O tax applies to your receipts, talk to a qualified attorney or CPA.

What You Need Before You Apply

Gather these items before you visit City Hall. A missing document is one of the most common reasons an application gets sent back.

  • Business name and business address inside Fairmont city limits
  • Photo ID for the owner or authorized person
  • FEIN (federal employer identification number) or SSN
  • West Virginia sales tax number, if you sell taxable goods
  • State Business Registration Certificate from the WV Tax Division
  • Formation documents if you use an LLC or corporation (Form LLD-1 or Form CD-1 filing receipt)
  • ABCA license or contractor license, if your business needs one
  • Estimate of annual gross receipts by business category
  • Home occupation or mobile vending affidavit, if it applies (available on the city site)
  • Money for the application fee, which is assessed at application, so ask Finance for the amount before you go

Step 1: Confirm Your Address Is Inside City Limits

City taxes and licenses apply to businesses operating within the city. West Virginia has 55 counties and 230 incorporated places, so an address that feels like Fairmont may sit outside the city line. Call the Finance office at 304-366-6211 ext 330 to confirm your address before you sign a lease or buy equipment. A business located outside the city may face a different city license, or none at all.

Step 2: Form Your Entity, If You Use One

A sole proprietor can skip this step. An LLC files Articles of Organization (Form LLD-1) with the Secretary of State at a $100 filing fee. Standard processing takes 5 to 10 business days. Expedited options cost extra and are added to the filing fee: $25 for in-person same day, $25 for next business day, $250 for 2 hours, and $500 for 1 hour. Online filings through the WV One Stop Business Portal add a $1.00 portal processing fee.

Your LLC name must include the words limited liability company, the words limited company, or an accepted abbreviation such as LLC, L.L.C., LC or L.C. Corporations file Articles of Incorporation (Form CD-1) at the same $100 filing fee.

Two points cause confusion here. First, the Secretary of State filing is a registration, not a license, so it does not authorize you to open in Fairmont by itself. Second, West Virginia does not require a separate commercial registered agent. The Secretary of State can accept legal papers for your company, although you may name an agent if you prefer.

Step 3: Get the State Business Registration Certificate

Every individual or business entity must obtain a Business Registration Certificate from the WV Tax Division before engaging in business. The one-time fee is $30.00. Apply at business4.wv.gov or on Form WV/BUS-APP. The certificate is permanent until your business name, location or ownership changes, and each fixed business location needs its own certificate. City Hall will ask to see it.

Step 4: Register for Sales Tax If You Sell Taxable Goods

If you sell taxable goods, you need a West Virginia sales tax number. The state rate is 6%. Fairmont adds its own 1% city sales tax under ordinance 1655, effective July 1, 2016, so taxable sales inside the city carry 7% combined. Register through the WV Tax Division business registration page. Confirm with the Tax Division whether your particular sales are taxable before you assume you can skip this step.

Step 5: Check State Trade Licenses

West Virginia licenses many trades at the state level, separately from city licenses. Check this table before you advertise a service or take a job.

Trade or activityLicensing agencyWhen it applies
ContractorContractor Licensing BoardResidential work above $5,000 or commercial work above $25,000
ElectricianState Fire MarshalElectrical work
Plumber and HVAC technicianDivision of LaborPlumbing and HVAC work
AlcoholABCASelling or serving alcohol
Cottage food, hemp, kratom, pesticidesWVDAFood production, hemp, kratom and pesticide activity

If your work sits close to a threshold, ask the licensing agency how the job value is measured before you bid it.

Step 6: Find Your B&O Category and Rate

Fairmont's B&O tax is levied on gross receipts, and the rate depends on the category your business falls into. The state B&O tax applies only to utilities, so it does not reach a shop, contractor or service provider in Fairmont. The city rates are:

CategoryRate per $100 of gross receipts
Retail0.35
Service0.70
Contracting2.00
Amusement0.44
Rents1.00
Banking1.00
Natural resources1.00
Wholesale0
Manufacturing0

Wholesale and manufacturing have carried a zero rate since July 1, 2016, when Home Rule ordinance 1654 took effect. Those activities therefore carry no city B&O rate under the current schedule.

Here is how the math works. A retail business with $200,000 in gross receipts contains 2,000 units of $100, and 2,000 multiplied by 0.35 gives $700 in B&O tax on that revenue. A contractor with $300,000 in gross receipts owes 3,000 multiplied by 2.00, or $6,000. These figures are illustrations, not quotes. Ask Finance whether any deductions or exemptions apply to your receipts, and how a business with mixed activities is classified.

Step 7: Plan for the Fee, Inspections and Service Fee

Fairmont sets the license fee by business type, and the fee is assessed when you apply. The city does not publish the amount online. Call Finance at 304-366-6211 ext 330 before your visit and ask for the figure that matches your business type. Some businesses also require an inspection, and an inspection can delay your opening date, so ask whether yours is one of them.

Fairmont also has a city service fee. Many West Virginia cities charge a weekly per-worker service fee, and Fairmont's fee works the same way in concept. Ask Finance for the current amount and how it applies to your staff.

Step 8: Apply in Person at City Hall

New licenses are applied for in person at Fairmont City Hall, 200 Jackson St, Suite 301. Plan a visit rather than relying on mail. Bring your photo ID, your FEIN or SSN, your West Virginia sales tax number if you have one, your state Business Registration Certificate, and your ABCA or contractor license if your business needs one. Home occupation and mobile vending affidavits are on the city site if either applies to you.

Step 9: Check the Contractor Rules

Contractors doing jobs over $2,500 need a city license. Smaller jobs require only a General Handyman license. Because the line is set at $2,500, record the value of each job so you can show which requirement applied if the city asks.

Step 10: Ask About Home Rule B&O Credits

Fairmont's Home Rule B&O credits fall into four categories:

  • New or expanded business and job creation
  • Re-occupancy of a vacant structure
  • Historic district
  • Anniversary

Credits are not automatic. Apply to the Finance Director through the B&O office at 304-366-6212 ext 323. Ask which category fits your business, what documents support it, and when the credit is applied. Do not count on a credit lowering your bill until the office confirms it in writing.

Step 11: Calendar Your Renewals

Renew your city license before July 1 each year. The Secretary of State annual report, which costs $25, is due between January 1 and June 30 in the same window. Filing after June 30 costs $75 because of a $50 late fee. One reminder in early spring covers both the state and city deadlines.

If You Operate Under a Different Name

A trade name, or DBA, is filed with the West Virginia Secretary of State, not a county clerk. Individuals, sole proprietors and general partnerships file Form TN-1 with no filing fee. Corporations, LLCs and other registered entities file Form NR-3 for $25.00, plus a $1.00 processing fee if filed through the One Stop Business Portal. Register at the Secretary of State trade name page.

Common Mistakes to Avoid

  • Treating the Secretary of State filing as the license. Articles of Organization create the entity. They do not authorize you to do business in Fairmont.
  • Expecting a state B&O bill. The state B&O tax reaches utilities only. Your shop, contracting or service B&O bill comes from the city.
  • Skipping a Business Registration Certificate for each location. A second site needs its own $30.00 certificate.
  • Guessing the license fee. Fairmont sets fees by business type at application, and the amount is not published online. Call Finance first.
  • Misclassifying revenue. A mixed business can owe at different rates on different receipts. Ask Finance how to split them.
  • Missing the renewal. Renew before July 1 to keep your city license current.
  • Doing contractor work without the right city license. Jobs over $2,500 need a city license, so a contractor who takes larger jobs on a handyman license is out of compliance.
  • Assuming a credit applies. Home Rule credits require an application to the Finance Director.

What Results to Expect

Owners who work through these steps in order may expect the following results, although exact timing depends on your business type and how complete your file is:

  • A Secretary of State filing that is likely to process in 5 to 10 business days under standard processing, or faster with an expedited option.
  • A state Business Registration Certificate that you can present at City Hall as a required document.
  • A city license issued after an in-person application and any required inspection, with the fee amount confirmed by Finance beforehand.
  • An annual budget that accounts for the $25 annual report, the city license renewal, and B&O tax on your gross receipts at the category rate.
