How to Start a Wedding Barn or Event Venue in West Virginia: ABCA Wedding Venue Licence and Fire Code

If you want to learn how to start a wedding venue business in West Virginia, begin with one fact that changes your plan: the state has no venue licence. No single application lets you open a barn or event space. You build the venue from separate approvals. You form and register the business, get zoning permission for the land, clear fire and occupancy with two agencies, register for taxes, and, if you want to serve alcohol, choose one of the Alcohol Beverage Control Administration (ABCA) options.

The order matters. A venue that takes deposits before its fire and occupancy answers are settled can end up refunding couples or moving a ceremony at the last minute. The steps below follow the sequence that avoids that problem.

This article is informational content, not legal or tax advice. Zoning, alcohol, fire and tax outcomes depend on your property, your building and your plans. Talk with a qualified attorney and a CPA before you buy or lease property, sign a booking contract or apply for a licence.

What You Need Before You Start

Gather these items before you file anything:

  • A signed lease or purchase contract for the property, with the exact street address and parcel information
  • A simple site plan showing parking, road access, the event space, restrooms, exits and any outdoor areas you plan to use
  • A business name you have checked in the Secretary of State business search
  • Articles of Organization (Form LLD-1) if you form an LLC, plus the $100 filing fee
  • The Business Registration Certificate application (Form WV/BUS-APP, or online at business4.wv.gov), with the $30.00 fee
  • Contact details for the county or city planning office, the local fire department, the building official and the local health department
  • A written list of the contractors you plan to hire for renovation, with their license numbers
  • A floorplan of the licensed area, if you pursue an ABCA private club licence
  • A budget that covers licence fees, insurance, renovation and fire-related upgrades

Step 1: Form and Register Your Business Entity

Most venue owners form a limited liability company (LLC). You form one by filing Articles of Organization (Form LLD-1) with the West Virginia Secretary of State. The filing fee is $100, and standard processing takes 5 to 10 business days. If you need the result sooner, expedited options add to the fee: $25 for in-person same day, $25 for next business day, $250 for a 2 hour filing and $500 for a 1 hour filing. Online filings through the WV One Stop Business Portal add a $1.00 portal processing fee.

The name must contain the words limited liability company or limited company, or one of the abbreviations LLC, L.L.C., LC or L.C. Limited may be abbreviated Ltd. and Company may be abbreviated Co. The name must also be distinguishable from every other name already registered or reserved. If you need to hold a name while you finish your lease and design work, a name reservation costs $15 and lasts 120 days.

A registered agent is optional. Form LLD-1 asks for an agent for service of process only if you have one, and the Secretary of State can accept legal papers on the company's behalf. If you name an agent, it can be an individual resident, a corporation or another LLC. Keep that information current. Changes are filed on Form AAO for $15.00.

Every LLC also files an annual report. You file it between January 1 and June 30 of each year after the year you register, and the fee is $25. A filing made after June 30 costs $75 because a $50 late fee applies. Put June 30 on your calendar on the day you form the company.

If you will operate under a name other than your LLC name, such as the name on your website or sign, register a trade name (DBA). DBAs are filed with the Secretary of State, not the county clerk. For an LLC, the fee is $25.00, plus $1.00 if you file through the portal. The form is NR-3. Details are at https://sos.wv.gov/business/registration-and-waivers/register-trade-name-dba.

Step 2: Confirm Zoning Before You Buy or Book

Zoning is the step most likely to stop a venue before it opens. West Virginia has 55 counties and 230 incorporated places (towns, cities and villages), and the rules depend on where your property sits. If the land is inside a town or city, city zoning applies. If it is outside incorporated limits, county zoning applies. Either way, call the planning office before you sign anything and ask these questions:

  • Is event use, including weddings, receptions, outdoor ceremonies and overnight guests, permitted on this parcel?
  • If it is not permitted outright, what approval is needed, and how long does that process usually take?
  • What limits apply to parking, hours, amplified music and outdoor lighting?
  • Does the current agricultural or residential zoning change once you host paid events?

Get the answers in writing. A verbal yes from a staff member is not enough when a couple has paid a deposit.

Step 3: Get Fire and Occupancy Approval Before Booking

The State Fire Code (87 CSR 1, version effective 2026-07-01) applies to a venue like yours. Plan review and occupancy approvals run through the State Fire Marshal and the local fire department and building official. Ask both before you accept a single booking, because the state and local answers can differ and you need to know both.

When you call, ask:

  • What occupant load will the building be approved for, and how is it calculated?
  • What exit, egress and emergency lighting changes does the building need?
  • Do tents, stages, generators and temporary heaters fall under your approval, or do they need separate permits?
  • What must you submit for plan review, and who signs the final occupancy approval?

Barn renovations bring in trade licensing too. Electricians are licensed by the State Fire Marshal, and plumbers and HVAC technicians are licensed through the Division of Labor. The Contractor Licensing Board requires a license for residential work above $5,000 and commercial work above $25,000. Confirm those thresholds and the licensing rules with the board before you hire anyone, and check each contractor's license yourself.

Step 4: Register for the Business Registration Certificate

West Virginia has no general statewide business license. The closest requirement is the Business Registration Certificate from the State Tax Division. Every individual or business entity must hold one before engaging in business activity. The one-time fee is $30.00. The certificate is permanent until the business name, location or ownership changes, and each fixed business location needs its own certificate. Apply on Form WV/BUS-APP or online at business4.wv.gov.

Your Secretary of State filing does not replace this certificate. Occupational, professional and municipal licences may apply on top of it.

Step 5: Decide Your Alcohol Plan Early

Many couples expect a bar, so decide this before you design the building. Serving alcohol requires an ABCA licence, and the options differ in fees and property requirements.

ABCA optionFeeWhat it requires or fits
Private wedding venue or barn licence$1,650 a year plus $100 operational feeBuilt for a wedding venue or barn. Confirm eligibility and the licensed area with ABCA.
Private club licenceConfirm with ABCAFor a place open only for reserved weddings, reunions, conferences and similar events. Requires at least 25 members, a restaurant with a full kitchen or a food caterer under written agreement, a property of at least two acres that is remotely located, and a floorplan listing the licensed premises (60-7-2).
Private caterer licence$1,000Needs a private club restaurant licence. Confirm with ABCA how this applies to your setup.
Fairs and festivals special events licence$500For special events of that kind. Confirm whether it fits your event calendar.

For a typical wedding barn, the practical choice is usually between the wedding venue or barn licence and the private club route. The private club route depends on land size, remote location and membership requirements, which may not fit your property. Read those conditions before you commit money to a floorplan.

Step 6: Plan Food Service With the Local Health Department

On-site food service is permitted through the local health department. If you plan to prepare food in the building, ask early about kitchen requirements, including sinks, prep space and water supply. Those answers shape the renovation budget, and they are much cheaper to plan than to fix after construction.

If a licensed caterer will serve the food, confirm who holds the food permit for each event and get the caterer's agreement in writing. The private club route also requires a written agreement with a food caterer if you do not have a full kitchen.

Step 7: Check City Taxes and Licences if You Are Inside a City

City location changes your tax picture. West Virginia's state business and occupation (B&O) tax applies to utilities. The gross-receipts business and occupation tax that applies to services is levied by cities, and cities also require a city business licence and a weekly per-worker city service fee. Ask the city clerk or finance office for their rate, filing schedule and licence requirements.

Sales tax is a separate question. The state sales tax rate is 6%. Today 101 municipalities add a 1% local sales tax on top of it, and 107 municipalities will do so from January 1, 2027. Ask the State Tax Division whether your receipts, such as venue rental fees and add-on services, are subject to sales tax, and whether your city adds the 1%. If you need to collect sales tax, register through the Tax Division at https://tax.wv.gov/Business/BusinessRegistration/Pages/BusinessRegistration.aspx.

Step 8: Confirm Approvals in Writing, Then Open Bookings

Before you take your first deposit, your file should contain:

  • Your LLC filing confirmation and any trade name registration
  • Your Business Registration Certificate
  • The zoning answer in writing from the planning office
  • Fire and occupancy answers from the State Fire Marshal and the local fire department and building official
  • Health department guidance for any food service
  • ABCA approval, if you serve alcohol
  • City tax and licence registrations, if you are inside a city

Only then should you publish your booking calendar and sign your first contract.

What to Expect Once the Approvals Are in Place

A venue that completes these steps in order may be able to open with fewer surprises, because each question was answered before a couple committed to a date. Timelines vary. Standard LLC processing takes 5 to 10 business days, but zoning, fire review, renovation and ABCA decisions can take longer, and no approval is guaranteed. Build that extra time into your first event date, and keep a backup plan for outdoor ceremonies in case a permit or inspection is delayed.

Common Mistakes to Avoid

  • Treating the Secretary of State filing as the license. Forming the LLC creates the entity. You still need the $30.00 Business Registration Certificate and every approval listed above.
  • Booking events before fire and occupancy approval. A signed contract with a date you cannot legally use creates refund disputes and reputational damage.
  • Assuming agricultural land allows events. Zoning is set by the county or city. Ask the planning office before you buy.
  • Choosing the alcohol option last. A private club route needs at least two acres, a remote location and a floorplan. Choosing that after the building is designed can force expensive changes.
  • Forgetting the June 30 annual report. Filing after June 30 costs $75 instead of $25.
  • Ignoring city tax if you are inside city limits. The city business and occupation tax and city licence are separate from the state registration.
  • Hiring unlicensed trades for renovation. Check the Contractor Licensing Board thresholds, electrician licensing with the State Fire Marshal and plumbing and HVAC licensing with the Division of Labor.
  • Setting up a second location under one certificate. Each fixed business location needs its own Business Registration Certificate.
