How to Start an Insurance Agency in West Virginia: Insurance Commissioner Producer Licence
How to Start an Insurance Agency in West Virginia: Insurance Commissioner Producer Licence
If you want to start an insurance agency business in West Virginia, you are doing two jobs at once. The first is forming a company with the Secretary of State, which makes the agency a legal entity. The second is licensing with the Offices of the Insurance Commissioner, which authorizes the agency and the people who sell for it. Most delays come from doing these in the wrong order or mixing up the two agencies. This guide walks through both tracks in sequence, using the fees and deadlines from the Commissioner's fee sheet updated August 19, 2026.
This article is informational, not legal, tax or insurance advice. Fees and rules change, so confirm every figure with the agency named before you pay or file. If your ownership is complicated or you plan to operate in more than one state, speak with a qualified attorney or CPA.
What You Need Before You Start
Gather these items before you open any form:
- A proposed agency name that includes an approved entity designator and does not match any name already registered or reserved with the Secretary of State.
- A principal office address. Any address change must be reported to the Commissioner within 10 days.
- The names of your officers and directors. Changes to them must also be reported within 10 days.
- One person to act as Designated Responsible Licensed Producer (DRLP). The agency needs at least one, and that person must hold a West Virginia producer licence.
- Access to NIPR, the online system used for the producer application. NIPR may add its own processing fees on top of the state fees.
- A budget for the state fees below, plus pre-licensing course tuition, which is set by each provider.
Here are the costs you should plan for. Confirm each one on the agency page before you pay.

Step 1: Form the Company With the Secretary of State
Form the entity first. The agency should be formed with the Secretary of State, and the legal name on that filing should match the name you use on your licence applications. Many agencies choose an LLC, which is the structure this example follows. Corporations file Articles of Incorporation (Form CD-1) for the same $100 fee.
For an LLC, the company name must include 'limited liability company', 'limited company', or one of the abbreviations 'L.L.C.', 'LLC', 'L.C.' or 'LC' under WV Code 31B-1-105. 'Limited' may be shortened to 'Ltd.' and 'Company' to 'Co.' The name must also be distinguishable from every other name already registered or reserved. Search the Secretary of State database at apps.sos.wv.gov/business/corporations before you settle on a name. If you need time to finish your paperwork, you can reserve the name for 120 days for $15 at sos.wv.gov/reserveregister-business-name.
File the Articles of Organization online through the WV One Stop Business Portal at business4.wv.gov, or follow the instructions on the Secretary of State business page. Standard processing takes 5 to 10 business days. If you need the filing faster, expedited options are available for an added fee, as shown in the table above.
A registered agent is optional in West Virginia. The Secretary of State acts as attorney-in-fact for every entity that files organizing documents, so it can accept service of process for your company. If you name an agent on Form LLD-1, keep that agent and address current, because changes are filed on Form AAO for $15.
If your agency will write business under a name other than its legal name, file a trade name registration (DBA) with the Secretary of State, not the county clerk. An LLC or corporation files Form NR-3 for $25, plus a $1.00 fee if filed online.
Tax treatment also affects how you set up the company. A West Virginia LLC pays no state franchise tax and, as a pass-through entity, no corporation net income tax. Members report income on the personal income tax, which runs from 2.11% to 4.58% for tax year 2026. A corporation pays the 6.5% corporation net income tax. Ask a CPA which structure fits your ownership and goals before you file.
Step 2: Register With the WV Tax Division
West Virginia does not have a general statewide business licence. The closest thing is the Business Registration Certificate from the WV Tax Division, which costs $30 and is required before you engage in business activity. You apply on Form WV/BUS-APP or online at business4.wv.gov. The certificate is permanent until your business name, location or ownership changes, and each fixed business location needs its own certificate.
Registering with the Secretary of State does not replace this certificate. Filing the entity is a filing, not a licence. Check the WV Tax Division site for current registration details.
Local rules are a separate question. West Virginia's state business and occupation tax applies only to utilities. The gross receipts business and occupation tax that applies to service businesses such as an agency is levied by cities, along with a city business licence and a weekly per-worker city service fee. West Virginia has 55 counties and 230 incorporated places, and each city sets its own rules. Confirm with the city clerk where your office will be whether you owe any local licence or tax before you open.
Step 3: Choose Your Designated Responsible Licensed Producer
Your agency needs at least one Designated Responsible Licensed Producer. This person supervises the agency's licensed activity, so choose someone who is prepared for that responsibility. The DRLP must hold a West Virginia producer licence, which means the DRLP has to complete the producer steps below before the agency licence can be issued. If you are the owner and will not sell yourself, you still need to decide who serves as DRLP and make sure that person is licensed.
Step 4: Complete the Pre-Licensing Education
To get a producer licence you must complete 20 pre-licensing hours for each line of authority you want. The lines are life, accident and health, property, casualty, and personal lines. A licensee who plans to sell several lines needs 20 hours for each one. Choose an approved provider, confirm its price, and check how long it takes to finish before you schedule your exam.
Step 5: Pass the Pearson Exam
Once your course is complete, book the Pearson exam, which costs $84. Your course certificate is valid for 6 months. Book your exam early enough that you can sit for it and recover from a retake if needed without letting the certificate lapse.
Step 6: Get Fingerprints Through IdentoGo
Complete fingerprinting through IdentoGo for $47.25. The fingerprint result is valid for 60 days. Because the fingerprint result has its own clock, schedule it so that the application can be filed while the result is still valid. Do not let your fingerprints expire while you wait on the exam or on other paperwork.
Step 7: Apply Through NIPR for Your Licences
Submit the resident producer licence application through NIPR for $50. NIPR may add its own processing fees, so budget for those too. Enter your information exactly as it appears on your identification and your Secretary of State filing, because mismatched names are a common cause of delay.
Apply for the business entity (agency) licence for $200. Confirm with the Offices of the Insurance Commissioner how the entity application is submitted and whether it runs through NIPR as well. The entity is not licensed by line of authority, so you do not need a separate entity licence for each line you sell.
Adjusters and bail bondsmen are also licensed by the Offices of the Insurance Commissioner. If you plan to add adjusting or bail bonds later, ask the Commissioner's Licensing and Education Division what additional licences apply rather than assuming your producer licence covers them.
Step 8: Calendar Your Renewals and Reporting Duties
Your individual producer licence expires on the last day of your birth month and renews every 2 years for $50. A late renewal costs $100. Your agency licence renews each June 30 at $200, and a late renewal costs $225. Your LLC annual report is also due by June 30, so June 30 is both a licensing deadline and a Secretary of State deadline. Put both on your calendar the day you are licensed.
You must report changes to officers, directors or your address to the Commissioner within 10 days. Missing that window is one of the easiest compliance problems to avoid.
Common Mistakes to Avoid
- Treating the two filings as one. Forming the LLC with the Secretary of State does not license the agency, and the Business Registration Certificate is still required.
- Assuming there is a statewide business licence to buy. Local city licences and taxes are a separate question that you must check with each city.
- Letting a certificate or result expire. The course certificate lasts 6 months and the fingerprint result lasts 60 days. Plan your sequence around those clocks.
- Naming a DRLP who is not licensed. The DRLP must hold a West Virginia producer licence.
- Mismatched names. If the agency name on the Secretary of State filing differs from the name on the licence application, you create avoidable corrections.
- Missing the June 30 double deadline. The agency licence renewal, the LLC annual report and the $75 late fee after June 30 all land at the same time.
- Forgetting the 10-day reporting rule. Officer, director and address changes do not wait for your next renewal.
Tips for a Smoother Launch
- Reserve your name before you pay for courses, so you are not licensed under a name that another company has taken.
- Create one folder with copies of every receipt, filing confirmation and certificate. Your renewal dates are easy to lose track of otherwise.
- Ask the Commissioner's Licensing and Education Division to confirm any fee, timeline or form before you file, since state agencies can update their requirements.
- The West Virginia Small Business Development Center offers free business advising at wvsbdc.com and can help you think through the entity and licensing sequence.
What Results to Expect
If your filings are accepted and your licences are issued, you should end up with a registered company, a Business Registration Certificate, an agency licence, and a licensed producer who can sell on the agency's behalf. Many new agencies find that the paperwork takes longer than they planned, especially when a course or fingerprint result has to be redone. Build in extra time before you plan a launch date, and do not promise clients coverage or a start date until your licences are actually in hand.
Next Steps
Start with the Secretary of State so you have a legal name, then complete your producer education, exam and fingerprints in an order that keeps each result current. File the agency licence, set up your Tax Division registration and check your city requirements, then build your renewal calendar around June 30. Because insurance licensing and entity choice both carry real consequences, confirm each step with the agency named, and bring a qualified attorney or CPA in before you sign leases, hire staff or accept premium.
