Cross Lanes, Teays Valley and Cheat Lake: Starting a Business in an Unincorporated WV Community

Cross Lanes, Teays Valley and Cheat Lake: Starting a Business in an Unincorporated WV Community

If you are looking for a cross lanes wv business license, start with one fact: West Virginia has no general statewide business license. The closest thing is a $30 Business Registration Certificate from the State Tax Division, which applies everywhere in the state. Cross Lanes in Kanawha County, Teays Valley in Putnam County and Cheat Lake in Monongalia County are unincorporated, so the city layer that many new owners expect does not exist there. That changes what you pay and which offices you deal with.

This guide covers the steps for a business based in one of these three communities. It is informational content, not legal or tax advice. Read the disclaimer at the end before you rely on any figure.

Why the community name matters

West Virginia has 55 counties and 230 incorporated places, which are towns, cities and villages. Only incorporated municipalities can levy the city taxes and fees that hit shops, contractors and service firms. Cross Lanes, Teays Valley and Cheat Lake are census-designated places. The Census Bureau uses that label to map a community, but it is not a government. It has no council, no mayor and no city clerk.

For a business in one of these areas, that means three things:

  • There is no city business license to apply for.
  • There is no city B&O tax. The gross-receipts business and occupation tax is levied by incorporated municipalities under W. Va. Code 8-13-5.
  • There is no weekly city service fee per worker.

The state rules apply in full. The most common mistake is reading a Charleston or Morgantown checklist and assuming it covers your address. It does not.

Step 1: Confirm the address is unincorporated

Do not decide based on the mailing address. Postal names such as Charleston, Hurricane or Morgantown can appear on parcels outside city limits. Ask the clerk of the nearest municipality whether the parcel is inside its boundaries, and ask the county planning office about zoning (covered below). Annexation is the event that changes the answer. If a city annexes your area after you open, city tax and licensing rules can apply to you, so recheck the status if you move or the boundary changes.

Step 2: File your entity with the Secretary of State

Your legal structure is filed with the West Virginia Secretary of State, not your county. For an LLC, the formation document is Articles of Organization (Form LLD-1), filed for a $100 fee. Corporations file Articles of Incorporation (Form CD-1) for the same $100 fee. If you operate under your own name without forming an entity, confirm with the Secretary of State or an attorney whether you need a filing at all.

Your name has to meet state rules. An LLC name must include limited liability company, limited company, or one of the abbreviations L.L.C., LLC, L.C. or LC. Limited may be shortened to Ltd. and Company to Co., under WV Code 31B-1-105. The name must also be distinguishable from every name already registered or reserved. Search the register at http://apps.sos.wv.gov/business/corporations/ before you file. If you need time, reserve the name for 120 days for $15 at https://sos.wv.gov/reserveregister-business-name.

File online through the WV One Stop Business Portal at https://business4.wv.gov/. Online filings add a $1.00 portal processing fee. Standard processing takes 5 to 10 business days. Expedited options cost extra on top of the filing fee: in-person same day $25, next business day $25, 2 hour $250 and 1 hour $500.

A registered agent is optional at formation. Form LLD-1 asks for an agent for service of process only if you name one. West Virginia makes the Secretary of State your attorney-in-fact, so the state can always accept papers for your company. If you name an agent, keep the name and address current. Changes are filed on Form AAO for $15.

LLCs file an annual report for $25 each year after the year of registration, between January 1 and June 30. A filing after June 30 costs $75 because of a $50 late fee.

Step 3: Get the Business Registration Certificate

This is the document most people mean when they search for a cross lanes wv business license. Every individual or business entity must obtain a Business Registration Certificate from the WV Tax Division before engaging in business. The one-time fee is $30. Apply on Form WV/BUS-APP or online at https://business4.wv.gov/.

Four details matter:

  • The certificate stays valid until the business name, location or ownership changes. It is not an annual renewal.
  • Each business location needs its own certificate. A home office and a rented storefront require two.
  • Registering with the Secretary of State does not replace it. An LLC still needs the certificate after its formation filing is accepted.
  • Occupational, professional and municipal licenses may apply on top of it. The municipal layer does not apply in these three communities, but the state trade licenses below do.

Step 4: Register a trade name if you need one

If you do business under a name other than your legal name or your registered entity name, file a trade name registration (DBA) with the Secretary of State at https://sos.wv.gov/business/registration-and-waivers/register-trade-name-dba. Individuals, sole proprietorships and general partnerships pay no filing fee and use Form TN-1. Corporations, LLCs and other registered entities pay $25.00 and use Form NR-3. Online filings through the One Stop portal add a $1.00 processing fee. DBAs are filed with the Secretary of State, not with a county clerk.

Step 5: Register for state taxes

State tax rules are the same in an unincorporated community as anywhere else in West Virginia.

  • Sales tax. The state rate is 6%. Register for a sales tax permit through the Tax Division at https://tax.wv.gov/Business/BusinessRegistration/Pages/BusinessRegistration.aspx. Municipalities can add a 1% sales tax on top, and 101 do so today (107 from January 1, 2027). Check with the Tax Division which rate applies to a sale that crosses into a municipality that charges the add-on.
  • Income tax. West Virginia repealed its business franchise tax. An LLC pays no state franchise tax and, as a pass-through entity, no corporation net income tax. Its members report business income on the personal income tax, which runs from 2.11% to 4.58% for tax year 2026. A corporation pays a 6.5% corporation net income tax on federal taxable income.
  • State B&O. The state business and occupation tax applies only to utilities. Shops, contractors and service businesses owe the city version if they are inside a municipality, which these three communities are not.

Step 6: Check trade licenses

Trade licenses are set at the state level, so the same requirement applies in Cross Lanes as in Charleston. These are the agencies small businesses most often meet:

Trade or activityAgencyWhat to know
General contracting and remodelingContractor Licensing BoardRequired for residential work above $5,000 or commercial work above $25,000
Electrical workState Fire MarshalLicenses electricians. Check with the agency for scope and fees.
Plumbing and HVACDivision of LaborLicenses plumbers and HVAC technicians. Check with the agency for requirements for your role.
Alcohol salesABCA (Alcohol Beverage Control Administration)Needed before you sell alcohol
Cottage foods, hemp, kratom and pesticidesWVDA (West Virginia Department of Agriculture)Each product area has its own rules

Step 7: Food, lodging and home-based rules

Food. Food permits come from your county or regional health department, not the state. Fees are set under fee rule 64 CSR 30, but each office publishes its own schedule. Health departments are organized by county or region, so find the one that covers your parcel in Kanawha, Putnam or Monongalia County, such as the Raleigh County Health Department for a Raleigh County address, and ask for its current fees.

Lodging. If you rent rooms, cabins or a lake house, counties and municipalities may levy a hotel occupancy tax of up to 6% under W. Va. Code 7-18-2. The Tax Division does not administer this tax. Ask your county and the nearest municipality whether they levy it and how to register.

Zoning. County zoning exists only where the county commission has adopted it. Ask the county planning office whether your parcel is zoned and, if it is, what it allows for a home business, signage, parking and customer visits. Subdivision covenants and HOA rules are private and separate from zoning, so check your deed and plat too.

When annexation or a move changes the answer

Everything above assumes the parcel is unincorporated today. If a city annexes it, the city B&O tax, the city business license and the weekly city service fee can apply to you. A move within the same county can also cross a city line. Before you sign a lease or buy property, ask the planning office and the nearest city clerk to confirm the status in writing.

Common mistakes

  • Following Charleston or Morgantown city rules for an address outside their limits.
  • Treating a Charleston or Hurricane mailing address as proof of city status.
  • Assuming the Secretary of State LLC filing is the business license.
  • Skipping the Business Registration Certificate because you work from home.
  • Opening a second location without a second certificate.

Where to get help

Talk to a CPA before you choose a structure or add owners, and to an attorney about leases, employees or any dispute over city status. A short consultation before you file can prevent corrections later.
